Closed Meeting Investigator
The Town of Deseronto has appointed the AMO Local Authority Services (LAS) for Closed Meeting Investigations.
The Ontario Municipal Act allows for any person to request that an investigation be undertaken respecting whether a municipality, local board, or a committee of either, has complied with the closed meeting rules contained within Section 239 of the Act.
LAS has offered this service to Ontario municipalities since 2008. To deliver the required investigation services, LAS has contracted a third party, Aird Berlis. It maintains a roster of experienced and trained individuals located across Ontario to provide required investigative services at the most reasonable cost.

Investigation Request Process:
1. File a written request for investigation with the Clerk of the Municipality.
2. The Municipality sends the request and background documentation to the Investigator (Aird Berlis).
3. Initial review by Investigator will result in decision to proceed, or not proceed - with a reason, or withdrawal of request.
4. If decision is to proceed, investigation is completed.
5. Draft report filed and peer-reviewed by Investigator.
6. Final report prepared and submitted to Council or Local Board.
7. Report is made public by the Municipality.
Integrity Commissioner
The Town of Deseronto has appointed Mr. Benjamin Drory, ADR Chambers as the Integrity Commissioner for the municipality and authorize him to conduct inquiries upon complaint for rules governing ethical behaviour of Members of Council as they pertain to the Municipal Conflict of Interest Act and Code of Conduct.
The Integrity Commissioner's responsibilities include:
Conduct inquiries upon complaint for Municipal Conflict of Interest Act and Code of Conduct matters.
Provide advice to members of Council and local boards regarding their obligations under the Code of Conduct and Municipal Conflict of Interest Act.
Provide educational information to the public, the municipality, and Members of Council and local boards about the Code of Conduct and Municipal Conflict of Interest Act.
Complaint Filing Process:
Any individual who identifies or witnesses behaviour or activity by a sitting Member of Council that they believe is in contravention of the Code of Conduct for Members of Council or the Municipal Conflict of Interest Act may file a formal complaint with the following conditions:
1. All complaints shall be in writing and shall be dated and signed by an identifiable individual using the Formal Municipal Integrity Commissioner Complaint Inquiry Form or the Application for Municipal Integrity Commissioner Investigation under the Municipal Conflict of Interest Act Form.
2. The complaint must set out reasonable and probable grounds for the allegation that the Member has contravened the Code of Conduct or the Conflict of Interest Act. A supporting sworn affidavit setting our the evidence in support of the allegation must also be included.
3. The complaint shall be filed with the Municipal Clerk who shall forward the matter to the Integrity Commissioner for initial classification to determine if the matter is, on its face, a complaint with respect to non-compliance.

Commissioning Oaths
By virtue of office Clerks, Deputy Clerks and Treasurers may act as a Commissioner of Oath. A Commissioner of Oaths is empowered under provincial legislation to administer and witness the swearing of oaths or solemn affirmations in the taking of an affidavit for any potential legal matter. It is at the exclusive discretion of the individual Commissioner of Oaths whether or not they choose to sign the document. The Commissioner of Oaths may refuse to sign the document and will refer you to a lawyer.
